Appeals
Employees in the classified State Police Service and certain other people have a right to appeal certain employment actions. (See State Police Commission Rule 13.1).
Appeals are filed with the Commission through its Director, who serves as the "Clerk of Court" for the commission. Appeals may be filed by mail or at the Commission's office.
The Director receives appeals, maintains appeal files, sends notice of hearings, issues subpoenas, files and mails decisions and compiles the record, if judicial review is sought.
The Commission may appoint a Referee to hear appeals. A Commission Referee does not have "decisional authority"; they may not make final decisions to grant or deny an appeal. A Commission Referee may only conduct hearings, receive evidence and perform other duties ancillary to managing and hearing an appeal. After hearing an appeal, a Referee may make a recommendation to the Commission, however, only the Commission may decide an appeal.
All appeals to the Commission, including appeals of disciplinary actions, discrimination and violations of the Article or the Rules, are governed by Chapter 13 of the State Police Commission Rules.
