General Circular No. 139 Issue Date: December 23, 2005
Subject: Revision of State Police Commission Rules 2.9(c), 6.16(f) and 11.9.
Pursuant to the provisions of State Police Commission Rule 2.10(a), the State Police Commission will hold a public hearing on Thursday, February 16, 2006, to consider revision of State Police Commission Rules 2.9(c), 6.16(f) and 11.9. The hearing will begin at 9:00 a.m. in the Conference Room, Eleventh Floor, Wooddale Towers Building, 1885 Wooddale Boulevard, Baton Rouge, Louisiana. The proposed revisions and/or adoptions appear in bold print.
CHAPTER 2
ORGANIZATION, RULES, PROCEDURES AND POWERS OF THE
STATE POLICE COMMISSION

2.9 Powers of the Commission.
(c) To conduct investigations whenever it has reason to believe the provisions of the State Police Commission Article or Rules are being violated or have been violated by any person or department; and to hold public hearing when charges of such violations have been filed with it. The Commission may issue appropriate orders in any such case, in addition to those orders provided for in Subsections (h) and (i) of this Rule.

CHAPTER 6 PAY PLAN

6.16 Special Pay Rates.
(f) The special pay rates authorized by the Rule shall not be effective until approval by the Commission at a public Hearing; with the limited exception that the State Police Commission Director may grant interim approval of individual pay adjustments for an employee until the next Commission meeting where a pay adjustment request can be placed on the agenda. At that time, the appointing authority shall provide justification for the special pay adjustment. In the event the request is denied by the Commission, the employee shall not suffer any loss of pay from the date of the interim approval until the date the Commission denies the request.

HOURS OF WORK, ANNUAL, SICK AND OTHER FORMS OF LEAVE

11.9 Enforced Annual Leave.
(a) Keep as written.
(b) When an Appointing Authority requires an employee to take annual leave pursuant to Subsection (a), above, it shall, in writing, advise the employee of the reason for such action. An employee may appeal the decision placing him on enforced annual leave. Such an appeal is subject to Chapter 13 of these Rules.

If you would like to appear before the Commission and present your comments orally, you are invited to do so. You must notify this office by Monday, January 23, 2006 of your intention to address the Commission, in order to be placed on the agenda.
Please post this General Circular in a prominent place, so that all employees will receive notice of these public meetings. If any special accommodations are needed, please notify us prior to the meeting date.
